By practice area

Reply rate by attorney practice area

Practice areaMedian reply rateNote
Personal injury3.8% replyHighest cold-tolerance; volume buyers
Criminal defense4.6% replySmall firms, principals answer own inbox

Real estate3.1% replyTransactional, less patient with vendor pitches

Estate planning and family law consistently outperform because those practitioners typically read their own inbox and are less saturated with vendor outreach than the personal-injury channel.

Why the gap

Why bar-sourced beats aggregator by 15 points

  • Weekly refresh from the source of record. Attorneys change firms and move to inactive daily. A weekly bar-directory re-pull catches most of that churn before it becomes a bounce.
  • SMTP verification on collection. Every address is validated at pull time, not months later at send time.
  • Catch-all and role inboxes flagged. A "info@" or catch-all row inflates delivered rates but crushes reply rates. We exclude both from the deliverable count.
  • Real firm, real practice, real license. Bar-sourced records carry bar number and active status, so you can suppress inactive attorneys and out-of-jurisdiction records before send.
How to use these numbers

Practical benchmarks for your program

Use the 97%+ delivered and sub-2% bounce rows as the minimum acceptable threshold for any attorney list you buy. Anything materially below that means the vendor is not re-verifying pre-send, and your sender reputation will pay the price.

Methodology

How the benchmark was compiled

Aggregated from BarSourced customer sending data across the CA, FL, GA, and TX catalogs, rolling 90-day windows ending August 2026. All figures are medians, not means. Aggregator comparison is drawn from a peer-vendor sample of lists purchased in the same period, re-tested against the same SMTP validation stack.

Reply-rate figures are only counted for sends where the list was SMTP re-verified within 24 hours of the send. Auto-replies, out-of-office bounces, and vacation responders are excluded from the reply numerator.

Frequently asked questions

How was this benchmark measured?
Aggregated from BarSourced customer sending data across the four state bar catalogs (CA, FL, GA, TX), rolling 90-day windows, medians (not means) to suppress outliers. Every list included in the sample was SMTP re-verified within 24 hours of send.
Why is deliverability so much lower on aggregator lists?
Aggregators pool addresses from many sources without weekly re-verification. Attorneys change firms, retire, and move to inactive status daily; without a fresh SMTP pass, a meaningful percentage of any purchased list is dead on arrival.
What reply rate should I expect?
Personalized, one-line first-touch outreach to a bar-sourced list medians around 4% in this dataset. Templated, non-personalized outreach sits below 1%. Personalization on the first line is the single biggest driver.
How often is the benchmark refreshed?
Quarterly. The page header shows the latest refresh date. Cite BarSourced with a link back to /report/legal-email-deliverability-benchmark-2026.
